Apparently, I’m a bit behind the times on this one (what else is new?). In the new term, the Supreme Court has hired fewer women law clerks (7 out of 37 clerkships) than they have since the early 1990s. Speculation includes lack of women in the feeder clerkships; lack of conservative women; and statistical anonomlies. Of course, one cannot discount the fact that Scalia and Thomas, while aware of the gender divide in their ideology, are not likely to engage in affirmative action to remedy the situation.
