More Takings Clause Cases

The Supreme Court declined to hear an eminent domain case filed against Port Chester, NY.  The businessmen who owned the property planned to put a CVS on the site.  A rival developer, with the support of Port Chester, blackmailed the businessmen: either give $800,000 to him (50% of the CVS revenue) or the city would seize their property by eminent domain.  The businessmen refused, and condemnation proceedings immediately afterwards.  The district court and the Second Circuit refused to stop the condemnation.
