Bleg for Copyright Experts

By “experts,” this pachyderm means someone with an actual law degree, not 2/3ds of one. ;)  Rough outline: can a company criticise its competitor via a website, and, to fend off rebuttals, state that the material is copyrighted IP and cannot be used without written permission?  Sec. 106 seems to enumerate (and therefore limit) rights in copyrighted works; Sec. 107 implies (well, on its face) that you don’t need someone’s permission to critique their work – that being the entire point of Sec. 107-122.
